The SC/ST court, on Thursday, rejected the bail applications of three doctors and a compounder in a bribery case.
Judge Rekha Dixit observed that considering the nature of the case and charges levelled against the doctors and material such as video footage, phonogram script and pictures, she was of opinion that this it was not a fit case for bail.
Dr Shailendra Tiwari, DK Srivastava and Nasir Husain and compounder VP Yadav had been arrested after a sting operation on August 24 on charges of preparing medico legal certificates after seeking money. The arrests were made on the complaint of a reporter of a TV channel. Dr Shailendra Tiwari and Nasir Husain and VP Yadav were arrested from UHM Hospital and Dr Srivastava from KPM Hospital.
Dr Srivastava urged that the incident had taken place on August 18 last while report was lodged six days later on August 28.
Counsel for Dr Shailendra Tiwari claimed that video was fabricated and any computer savvy person could make it. His client had not taken money.
The district government counsel urged that the offence committed by the accused was against the society. Due to fake medico legal certificates, several complaint cases under Section 156(3) CrPC had been filed in the courts.
There were two sting operations. One was conducted by Sanjay, who trapped the accused in UHM Hospital while Vipin conducted a sting operation at KPM Hospital under the pseudo name of Sanjay Bhadoria. Vipin had stated in his statement that a deal had taken place between him and Dr Shailendra Tiwari. Dr Tiwari had taken Rs 14,000 from him had directed to come on August 23 to get the prepared medico legal certificate .
Video footage was on record and phonogram was also on the record. All the arrests were made after wide discussions.
